NDC leaders in Parliament in a jubilant mood as the Speaker Alban Bagbin has directed the Clerk to return court documents served by bailiffs on the Parliamentary Service.
This directive effectively allows the NDC minority to hold the majority of seats in Parliament.
Taking to his X handle, the Member of Parliament for Madina, Francis-Xavier Sosu, expressed his gratitude for the Speaker, stating that the Supreme Court orders are “obviously only an exercise in futility.”
He praised Speaker Alban Bagbin for standing firm, asserting that the NDC remains the majority in Parliament.
On October 18, the Supreme Court issued a stay of execution on Speaker Bagbin’s ruling, which had declared four parliamentary seats Fomena, Agona West, Amenfi Central, and Suhum vacant.
The ex parte application to stay the Speaker’s decision was filed by NPP MPs, led by Alexander Afenyo-Markin, who sought the Court’s intervention to halt the enforcement of the ruling that could impact their majority status.
Following this, on October 22, Speaker Bagbin adjourned the sitting sine die after NPP MPs walked out, allowing NDC MPs to occupy the majority side of the aisle.
As NPP MPs gather signatures to recall the House, the Speaker has responded to the Supreme Court’s service of court documents by citing constitutional immunity under Article 117 of the 1992 Constitution.
