The Accra High Court today, July 31, has dismissed Chief Justice Gertrude Torkornoo’s application for judicial review.

The Human Rights Division of the Accra High Court described the suspended Chief Justice’s review request as an abuse of court processes, asserting that it lacks jurisdiction.

The ruling by the High Court suggests that Gertrude Torkornoo’s improper use of legal proceedings was for an ulterior purpose or to vex, harass, or delay justice.

It suggested that the court found Torkornoo’s application to be an attempt to obstruct the legitimate process.

Chief Justice Gertrude Torkornoo is currently the subject of impeachment proceedings under Article 146 of the 1992 Constitution.

She filed an application seeking to quash the ongoing process, challenge the legality and constitutionality of the impeachment mechanism itself.

This is another legal blow to Chief Justice Gertrude Torkornoo has received after three separate injunction applications previously filed at the Supreme Court were also thrown away.

Also, Justice Srem-Sai, the Deputy Attorney General, has revealed that the suspended Chief Justice of Ghana, Gertrude Araba Esaaba Torkornoo, filed another case at the ECOWAS Community Court of Justice in Abuja, Nigeria.

In the case, which was filed on July 4, Her Ladyship repeated the same allegations of human rights violations which are currently pending determination before our Supreme Court and, also, before our High Court in respect of the ongoing removal processes.

Essentially, Her Ladyship argues that by her suspension, she “has effectively been removed from her official capacity without a final determination, impairing her right to function and serve in a position she was constitutionally appointed to.”

In her lawsuit, Justice Torkornoo accused President John Dramani Mahama of failing to specify the claims in the petitions for her removal.

According to the details of the lawsuit, suspended Justice Torkornoo is seeking ten reliefs from the ECOWAS Court, including a $10 million compensation for moral and reputational damages suffered by the Applicant as a result of her illegal suspension and unfair investigation.

Also, a declaration that the suspension of the Applicant (Justice Gertrude Araba Esaaba Sackey Torkornoo) as the Chief Justice of the Republic of Ghana by the President of the Respondent State on 22 April 2025 violated the Applicant’s human right to a fair hearing guaranteed by Article 7 of the African Charter on Human and Peoples’ Rights.

Meanwhile, President John Dramani Mahama has stated that his government is awaiting the outcome from the committee he set up to probe the suspended Chief Justice, Gertrude Torkornoo.

According to John Mahama, his government has done its part, and the rest is left with the committee that was set up to come out with whatever its findings are.

He revealed that whatever the committee’s findings are, it will be dealt with.

John Mahama, addressing members of the Council of State at the Jubilee House on Monday, July 7, stated his administration is awaiting the outcome of the special committee investigating the suspended Chief Justice, Gertrude Torkornoo.

John Mahama stated, “On the issue of governance, we’ve had the difficult issue with regards to the suspension of the Chief Justice and of course, the Council of State was involved in a part of that process,” the President said.

“We’ve done our part. The rest is left with the committee that was set up to come out with whatever its findings are, and based on that, whatever the consequential issues are, will be dealt with.”
