The High Court Criminal Division has dismissed an application by former Finance Minister Ken Ofori-Atta seeking to strike out a warrant issued for his arrest by the Office of the Special Prosecutor (OSP).
Ken Ofori-Atta’s legal team had argued that the OSP unlawfully obtained the warrant and asked the court to set aside all related proceedings, including an Interpol Red Notice alert.
However, the court on Thursday, July 31, 2025, ruled that the application lacked merit and dismissed it in its entirety.
Mr Ofori-Atta, who is under multiple investigations by the OSP and other state agencies relating to his tenure in office, had asked the court to restrain the OSP from issuing a “wanted” notice and from circulating his image online.
He is currently the subject of an active Interpol Red Notice, and extradition proceedings have begun with the relevant authorities to secure his return to Ghana.
Also, Prof Mrs Angela Ofori-Atta, the wife of Ken Ofori-Atta, has stated her husband would require about 3 months to recover fully.
The wife of Ken Ofori-Atta, on June 16, revealed that his surgery was successful.
According to Mrs Angela Ofori-Atta, Ken Ofori-Atta had a successful surgery for prostate cancer at the Mayo Clinic in Rochester, Minnesota.
On Monday, June 16, a statement issued by Prof. Mrs. Angela Ofori-Atta revealed a robotic-assisted radical prostatectomy took place on Friday, June 13, and lasted over four hours.
She stated, “The doctors are pleased with how the procedure went and will now place him on a postoperative regime”.
“Kenneth has always been resilient. But this has been very difficult; with the OSP choosing the period just before his surgery to declare a red alert on him,” she noted.
She added, “Our family is truly grateful for the support and prayers of many people and pastors”.
Meanwhile, the information gathered reveals that the US Department of Justice and the FBI have cleared the first major hurdle for former Finance Minister, Ken Ofori-Atta, for extradition.
According to reports, the US Embassy in Accra has revealed that the principal federal law enforcement agency has satisfied itself that Ken Ofori-Atta is not being witch-hunted.
Under the immigration law and international human rights obligations, foreign nationals in the US can seek legal protection by claiming they are being witch-hunted back home.
The US Embassy revealed that the request for the finance minister to respond in Ghana is legitimate.
The Office of the Special Prosecutor has been on the heels of the former finance minister to account for his stewardship in the Nana Akufo-Addo-led administration.
