Private legal practitioner Amanda Clinton has criticised the Office of the Special Prosecutor’s (OSP) decision to publicly declare former Finance Minister Ken Ofori-Atta wanted again.

According to Amanda Clinton, the OSP action will tip off Ken Ofori-Atta who could have been quietly intercepted.

Speaking on JOY NEWS AM Show, Amanda Clinton detailed, “A Red Notice is primarily for law enforcement agencies around the world—not the general public,” Clinton emphasised.

“If Ghana genuinely wanted help in locating and apprehending him, the Red Notice could have been listed as confidential. This way, only international law enforcement would be alerted, and he could be quietly intercepted without tipping him off,” She argued.

Ms Clinton explained, “The real purpose of a red notice is a high-net-worth individual taking a private jet or a commercial plane somewhere and then just being nabbed because there is a silent red notice as to this being a person to be picked up”.

Her comment comes on the back of the Special Prosecutor revealed that he has triggered a process for the issuance of an INTERPOL red notice, potentially subjecting Ken Ofori-Atta, to international arrest and extradition.

Speaking to the media on Monday, June 2, Kissi Agyebeng stated, “About 30 minutes before this brief, I triggered processes for the issuance of an INTERPOL red notice for the location and provisional arrest of Mr. Ken Ofori-Atta in whichever jurisdiction, pending extradition or his surrender”.

The Special Prosecutor rejected the former Finance Minister Ken Ofori-Atta’s request for a virtual session.

According to Kissi Agyebeng, Ken Ofori-Atta must present himself physically to the Office of the Special Prosecutor (OSP).

Kissi Agyebeng stated, “This office has always requested his attendance, and we have indicated clearly to him that we are unwilling to waive it. If we were amenable to taking any statement from Ken Ofori-Atta in absentia, we would have done so in February, and not waited till June 2, 2025.

“We want him here physically, and we insist on it. A suspect in a criminal investigation does not pick and choose how the investigative body conducts its investigations and the methods suitable to him and his convenience. We will not countenance this conduct, not in this case”, he added.

Ken Ofori-Atta has since been listed on Interpol’s official website as  Wanted.
