Edudzi Tamekloe, the acting Chief Executive Officer of the National Petroleum Authority (NPA) and the head of the NDC legal team has schooled Samuel Atta Akyea that he should be advising his client the Director-General of the National Signals Bureau (NSB) Kwabena Adu-Boahene on how to spend less than 25 years in jail.
According to Edudzi Tamakloe, he read Atta Akyea’s statement and he has been laughing.
He asserted that looking at the particulars of the offences one would be noticed that the offences happened in January and March 2020.
Edudzi revealed that the Security and Intelligence Act, 2020 was assented to in October 2020.
Edudzi Tamekloe wrote, “Clearly at the time, the accused person entered the contract with the Israeli company, this Act was not in existence. So how are you relying on this Act for your prior conduct? As lawyers, we have ethical responsibility to advise our clients well. You don’t make life difficult for the client.
Criminal defence is a special skill. The case of the Prosecution is simple. That you were the Director of a state agency responsible for the soft side of national security.
That in January 2020, you entered into a contract with an Israeli company to supply and install security equipment.
That contemporaneous with this, you incorporated a company similar to the State agency but private”.
He added, “ You diverted public funds directly into this private company. The basis of the Prosecution case of stealing is because you moved the funds directly into your private company.(Appropriation)
That the appropriation was done dishonestly. If you don’t understand the charges, how can you defend yourself? Alleged payments to MPs after the fact of the appropriation cannot negative the dishonesty associated with the appropriations.
The alleged payments in 2024 election almost four years after the fact is an afterthought. At this rate, your lawyers should be advising you on how to do less than 25yrs”, he wrote.
His comment comes after the lawyer for the embattled former Director-General of the National Signals Bureau (NSB) Kwabena Adu-Boahene stated the intended prosecution of their client has national security implications.
Lawyer for Adu Boahene a former Member of Parliament for Akim Abuakwa South, Samuel Atta Akyea in a letter to the National Security Council Secretariat warned that the prosecution of Adu Boahene could lead to potential threats to Ghana’s national security.
Samuel Atta Akyea revealed that there were going to be consequences on Ghana’s national security if the prosecution of his client persisted.
He asserted that the prosecution of his client also violates the country’s laws, including Act 1030 and Act 1040.
Part of the letter reads.“Our client has instructed us that a cursory look at the case from the documents you inherited underscores the fact that the pith of the Hon. Attorney-General’s case is matters bothering national security.
“Besides, the intended prosecution violates the Security and Intelligence Agencies Act, 2020 (Act 1030) and the National Signals Bureau Act, 2020 (Act 1040),”
The acts referred to are the Security and Intelligence Agencies Act which govern Ghana’s intelligence operations and may offer protections for officials, like requiring warrants for investigations.
“We attach a memorandum under the hand of our client, who is at the moment incarcerated at the Economic and Organised Crime Office (EOCO) cells. May we count on your usual sense of professionalism in your evaluation and the proffering of the critical understanding of the matters therein contained,” the letter concludes.
Meanwhile, Kwabena Adu Boahene, his wife Angela Adjei-Boateng and two others have been charged by the state with stealing, defrauding by false pretences, money laundering, and conspiracy to commit a crime.
According to the charge sheet Kwabena Adu Boahene, his wife stole state funds to the tune of GHc 49 million.
The Attorney General, Dr Dominic Ayine, filed 11 charges against Kwabena Adu-Boahene and three others at the High Court in Accra.
Adu Boahene has since been remanded by an Accra High Court into the custody of EOCO for seven working days.
According to the court, Kwabena Adu-Boahene will be remanded for seven working days to enable the Attorney General Dr Dominic Ayine to complete the preparation of its witness statements.
