Kwaku Ansa-Asare, the former Director of the Ghana School of Law has said the suspended Chief Justice, Gertrude Torkornoo and her legal team are merely barking as they cannot bite.

According to Mr Ansa-Asare, the Chief Justice’s injunction undermines the Constitution.

He further accused the CJ and her lawyers of attempting to disrupt a lawful process.

The suspended CJ  filed a lawsuit at the Supreme Court to stop the five-member committee probing her removal.

On Wednesday, May 21, 2025, the Chief Justice requested an interlocutory injunction to halt all proceedings of the committee.

She’s seeking an injunction to halt proceedings, remove two justices Pwamang and Adibu-Asiedu from the panel, and quash her suspension issued by President Mahama.

Speaking on JOY FM, Kwaku Ansa-Asare stated, “This is a very worrying unfolding story that Chief Justice Gertrude Torkornoo will seek to stop the constitutional process. Any application to stop the process will itself be unconstitutional”.

“The law is that when the application involves the Chief Justice, it is the president and the president alone who may initiate the Chief Justice’s removal process pursuant to the petition to that effect”.

“The President has not violated any of the chronological stages in the process. Therefore, it will be a very difficult task for anyone to halt it,” he added.

He continued, “It will be a very difficult task for anyone to seek to halt the process. What the lawyers are doing at the moment and what the chief justice herself has done is to bark but cannot bite; they are merely barking.”

Meanwhile, Edudzi Tamakloe, the Director of Legal Affairs for the National Democratic Congress (NDC) has welcomed the Chief Justice’s injunction application.

Edudzi Tamakloe asserted that the injunction application filed by the Chief Justice is quite refreshing.

Speaking on CITI FM he stated, “This application by Her Ladyship herself to restrain the committee from performing its constitutional task comes to me as quite an interesting one, giving the reliefs, and also looking at the injunction application”.

“I’m happy that the suspended Chief Justice is going to have the benefit of how the justice system works. Just like any one of us, her leadership may need the benefits of the very justice she, together with others, over the years, delivered to people.”

“It is my hope and belief that she will be given all the opportunities required under our constitution as a citizen of this country. I think it’s quite refreshing,” he concluded.
