The lawyer for the embattled former Director-General of the National Signals Bureau (NSB) Kwabena Adu-Boahene has stated the intended prosecution of their client has national security implications.
Lawyer for Adu Boahene a former Member of Parliament for Akim Abuakwa South, Samuel Atta Akyea in a letter to the National Security Council Secretariat warned that the prosecution of Adu Boahene could lead to potential threats to Ghana’s national security.
Samuel Atta Akyea revealed that there were going to be consequences on Ghana’s national security if the prosecution of his client persisted.
He asserted that the prosecution of his client also violates the country’s laws, including Act 1030 and Act 1040.
Part of the letter reads.“Our client has instructed us that a cursory look at the case from the documents you inherited underscores the fact that the pith of the Hon. Attorney-General’s case is matters bothering national security.
“Besides, the intended prosecution violates the Security and Intelligence Agencies Act, 2020 (Act 1030) and the National Signals Bureau Act, 2020 (Act 1040),”
The acts referred to are the Security and Intelligence Agencies Act which govern Ghana’s intelligence operations and may offer protections for officials, like requiring warrants for investigations.
“We attach a memorandum under the hand of our client, who is at the moment incarcerated at the Economic and Organised Crime Office (EOCO) cells. May we count on your usual sense of professionalism in your evaluation and the proffering of the critical understanding of the matters therein contained,” the letter concludes.
Meanwhile, Kwabena Adu Boahene, his wife Angela Adjei-Boateng and two others have been charged by the state with stealing, defrauding by false pretences, money laundering, and conspiracy to commit a crime.
According to the charge sheet Kwabena Adu Boahene, his wife stole state funds to the tune of GHc 49 million.
The Attorney General, Dr Dominic Ayine, filed 11 charges against Kwabena Adu-Boahene and three others at the High Court in Accra.
Adu Boahene has since been remanded by an Accra High Court into the custody of EOCO for seven working days.
According to the court, Kwabena Adu-Boahene will be remanded for seven working days to enable the Attorney General Dr Dominic Ayine to complete the preparation of its witness statements.
