Opposition parties form alliance to protest suspension of Chief Justice

Various opposition parties in Ghana have united under one banner to fight what they describe as the unlawful suspension of Chief Justice, Her Ladyship Justice Gertrude Esaaba Sackey Torkornoo.

The main opposition party, the New Patriotic Party (NPP), together with four other political parties, Liberal Party of Ghana (LPG), the National Democratic Party (NDP), the People’s National Party (PNP), and the Ghana Union Movement (GUM), have slated 5th May, 2025 as they day of their nationwide protest.

At an emergency meeting held on Thursday, 24th April, the political parties described the Chief Justice’s suspension as unlawful and a “blatant disregard for the rule of law.”

A joint statement issued by the parties accused the ruling National Democratic Congress (NDC) of a calculated attempt to undermine and intimidate the judiciary.

The statement read, “The disturbing trend of judicial intimidation by the NDC is not new. The pattern is undeniable. A case in point is the NDC’s failed plot in 2010 to remove Ghana’s first female Chief Justice, Georgina Theodora Wood.”

“History is repeating itself. The NDC’s obsession with capturing and controlling every arm of government – including the independent judiciary – is playing out before our very eyes. We must not remain silent.”

The parties further stated, “This reckless assault on the independence of the judiciary is not merely an attack on one individual; it represents a grave threat to the very Constitution that upholds our democracy. Ghanaians must not forget the chilling legacy of the National Democratic Congress (NDC) in its dealings with the judiciary.”

In a final rallying cry, the group warned of creeping tyranny and called on the so-called “silent majority” to rise.

“To remain indifferent is to endorse the rise of an authoritarian state. Be a citizen, not a spectator. Stand for democracy. Oppose dictatorship.”

Describing the planned protest as a clarion call for justice and democracy, the NPP and the four allied parties called on all well-meaning citizens – including civil society organisations and religious bodies – to join the demonstration.

According to the presidency communication signed by the Minister of Government Communication, John Mahama suspended the Chief Justice following a prima facie case being determined against her by the Council of State.

Part of the statement read, “President John Dramani Mahama has, in accordance with Article 146(6) of the Constitution and in consultation with the Council of State, determined that a prima facie case has been established in respect of three petitions against the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo.

The President has consequently, established a committee in compliance with Article 146(6) of the Constitution and in consultation with the Council of State with the following composition to inquire into the petitions which have been referred to them”.

The committee is composed as follows:

Justice Gabriel Scott Pwamang, Justice of the Supreme Court – Chairman

Justice Samuel Kwame Adibu Asiedu, Justice of the Supreme Court – Member

Daniel Yaw Domelevo, Former Auditor-General – Member

Major Flora Bazwaanura Dalugo, Ghana Armed Forces – Member

Professor James Sefah Dzisah, Associate Professor, University of Ghana – Member

Meanwhile, the specific allegations contained in the petitions have not been publicly disclosed.
