Emmanuel Kporsu the head of public relations at the Rent Contol Department Ghana has boldly stated landlords in the country are prohibited from demanding more than 6 months’ rent advance.
According to Emmanuel Kporsu, the rent control laws of Ghana legally prohibit landlords from charging more than 6 months in advance payment for rent.
Emmanuel Kporsu explained that a tenant paying a landlord more than six months’ rent is not a crime.
The PRO noted that it is only an offence if the landlord demands more than 6 months’ rent advance.
He revealed that the law only prohibits landlords from making tenant demands.
The Rent Control Department Ghana PRO is quoted by TV3 to have said, “Landlords are not to demand more than 6-month rent advance according to law”.
Mr. Kporsu in an old interview stated “Section 25 subsection 5 of the existing law states that during a short tenancy, the landlord should not demand more than two months’ rent in advance.
If the tenancy is longer than six months, the landlord should not demand more than six months’ rent in advance. However, it is not a crime if the tenant pays the landlord for more than the approved number of months”, he added.
Meanwhile, some X user under the post has shared their thoughts questioning who enforces the rent control laws.
One user stated, “ This has been the story for God knows how long.. can we start implementing rather than quoting… I’m yet to see Tenants being protected in this country.. there are too many things going wrong in the secondary market as far as our real estate policies are concerned.. Landlords proving basic amenities feel they are doing a tenant a favour”.
“And who is enforcing this law? recently, my rent was up and I couldn’t afford to pay the 2 years because it clashed with my school fees and I used it to settle, my landlord reported me to the nearby police station and the police gave me 10 days authumatum” another stated.
