How Mahama can easily remove Chief Justice

In a recent post on X, an X user outlined how President-elect John Dramani Mahama could potentially remove the Chief Justice (CJ) from office, based on the constitutional provisions laid out in Article 146(1)(6)(7)(8)(9) of Ghana’s Constitution.

The process, which involves a series of steps, requires consultation, investigation, and parliamentary approval.

According to the constitutional process, the first step is for the President to receive a petition for the removal of the Chief Justice.

This petition can be filed by any individual or body with justifiable cause.

Once the President receives the petition, they are required to appoint a committee to investigate the matter.

The President must appoint this committee in consultation with the Council of State.

The committee is made up of a select group of individuals, including two justices of the Supreme Court, ensuring that there is legal expertise in the review process.

The committee’s role is to thoroughly investigate the allegations made in the petition, and if they find the claims to be valid, they will recommend the removal of the Chief Justice.

However, the final decision does not rest with the President alone.

Parliament must review the committee’s findings and approve the removal for it to take effect.
