Fanteakwa North NDC Parliamentary Candidate sues EC over results re-declaration

The National Democratic Congress (NDC) parliamentary candidate for Fanteakwa North in the Eastern Region, Haruna Apaw Wiredu has filed a lawsuit at the Koforidua High Court to challenge the alleged re-declaration of parliamentary election results at Tesano in the Greater Accra Region.

The suit, filed by Isaac Mintah Larbi, lead counsel at Okore Chambers, seeks judicial review, including orders for certiorari and prohibition.

The candidate, Haruna Apaw Wiredu, is also requesting that the court restrain the Electoral Commission (EC) from publishing, gazetting, or issuing any document recognizing the New Patriotic Party (NPP) candidate, Kwame Appiah Kodua, as the winner.

Kodua was declared the parliamentary candidate-elect following the EC’s re-collation of results on December 12.

The EC, named as the respondent, nullified the initial declaration of Haruna Apaw Wiredu as the winner in Begoro, citing procedural violations.

According to Returning Officer Zacharia Adams, the original results showed the NDC candidate securing 11,138 votes, compared to Kodua’s 10,847 votes.

Isaac Mintah Larbi, who also serves as the NDC’s Director of Legal Affairs for the Eastern Region, argued that the EC’s actions contravene constitutional instruments (CIs) that prohibit re-collating, recounting, or re-declaring already certified results.

He also challenged the EC’s use of the term “deputy returning officer,” a role not recognized under Ghana’s electoral laws.
