Alexander Afenyo-Markin, leader of the New Patriotic Party (NPP) caucus in Parliament, initiated the legal challenge against Speaker Bagbin’s declaration of the Fomena, Suhum, Amenfi Central, and Agona West seats as vacant.

This decision arose after MPs announced their intentions to contest the upcoming parliamentary elections as independent candidates, with Fomena in particular being represented by an independent MP who was previously affiliated with the NPP.
