The High Court in Accra presided over by Justice Richard Apietu has dismissed an application seeking to restrain Christian Tetteh Yohuno from holding himself as the Deputy Inspector General of Police in charge of Operations .
A private citizen, Emmanuel Felix Mantey took the matter to court after President Akufo-Addo appointed COP Tetteh Yohuno as the Deputy Inspector-General of Police in charge of Operations in a statement signed by the Director of Communications at the Presidency, Eugene Arhin, in July.
the appointment was made under the advice of the Police Council at its meeting which acknowledged COP Yohuno’s exceptional credentials and dedication to duty.
But Emmanuel Felix Amantey alleged that the police council and the presidency acted in excess of their powers when the two offices appointed a deputy IGP in charge of operations.
He says the constitution and the Ghana Police Service ACT are silent on such a role, but the only legal document that anticipates such an office is the police service regulation which does not make room for a deputy in charge of operations.
He was accusing the president and the police council of perpetrating an illegality. Justice Apietu further argued that the President and the Police Council were exercising administrative powers.
He thus dismissed the application.
