Flagbearer of the PNC, Bernard Mornah, has sued the Electoral Commission (EC) over his disqualification from this year’s presidential election.
In an application filed at the Accra High Court on Tuesday, September 24, 2024, Mr. Mornah is seeking, among other reliefs, an order restraining the EC from carrying out any activities related to the 2024 presidential election until he is declared a duly nominated candidate and allowed to contest.
He also wants an order of certiorari to quash the EC’s decision to disqualify him from the December 7 presidential election. Additionally, he seeks an order of mandamus compelling the Chairperson of the EC to declare him duly qualified to contest.
Mr. Mornah is further requesting a court declaration that the EC acted arbitrarily, unfairly, and capriciously in disqualifying him, thereby breaching Article 23 of the Constitution and violating his fundamental human rights.
In an interview with Yawa News, Mr. Mornah stated that the EC had no valid reason for his disqualification.
He maintains that he fulfilled all constitutional requirements for eligibility.
According to him, the 1992 Constitution mandates that a presidential candidate must be at least 40 years old, of sound mind, and a registered voter qualifications he met.
“Every error the Electoral Commission cited, particularly on pages 9, 10, 37, 39, 42, 46, and 50, were identified as having incomplete particulars of my supporters. The errors were corrected,” he said.
Mr. Mornah emphasized that unless the EC concealed some issues, they had deliberately used undisclosed reasons to disqualify his party without prior notice.
“If that were the case, or if the Electoral Commission did not identify certain errors before alerting us, how can their inadequacy be my liability?”
